1. Acceptance of Terms
By accessing or using the Acadya platform (the “Service”), you agree to these Terms & Conditions (“Terms”). If you are using Acadya on behalf of a school or other institution, you represent that you have authority to bind that institution to these Terms.
2. User Responsibilities
You agree to:
- Use the Service in a lawful manner and in accordance with institutional policies.
- Provide accurate information where you submit or update records.
- Respect the privacy and rights of students, staff, parents/guardians, and other users.
- Maintain the confidentiality of records you access and only use data for authorized educational or administrative purposes.
3. Account Usage Rules
Accounts are typically issued and managed by the subscribing institution. You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- Do not share your password or verification codes with others.
- Notify your administrator promptly if you suspect unauthorized access.
- Follow any security requirements (such as two-factor authentication) enabled by your institution.
4. Prohibited Activities
You must not:
- Access the Service using automated means except where explicitly permitted.
- Attempt to bypass or defeat security features, access controls, or licensing restrictions.
- Upload malicious code, harmful files, or content that is unlawful, abusive, or infringes others’ rights.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Use the Service to access, collect, or disclose personal data beyond what is authorized by your role.
5. Intellectual Property
Acadya and its associated names, logos, interfaces, and software are owned by Acadya and/or its licensors and are protected by applicable intellectual property laws. Your institution and users retain ownership of the data and content they upload or generate (“User Content”).
You grant Acadya a limited, non-exclusive right to host, process, transmit, and display User Content solely to provide and improve the Service, and as otherwise permitted by your institution and applicable law.
6. Limitation of Liability
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. Acadya will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenues, or goodwill.
Where liability cannot be excluded, Acadya’s total liability for claims relating to the Service will be limited to the fees paid for the Service by the subscribing institution during the applicable period, unless required otherwise by law.
7. Termination of Access
Acadya or the subscribing institution may suspend or terminate access to the Service for any user who violates these Terms, institutional policies, or applicable law, or where necessary to protect security and integrity. Upon termination, access to the Service may be disabled immediately.
8. Changes to Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the jurisdiction in which Acadya is provided and operated, without regard to conflict of laws principles, unless mandatory law provides otherwise.
